Staff working within Mental Health Trusts are prone to more assaults from patients / service users leading to higher levels of sickness absence due to staff injury and the psychological effects.  This impacts on shorter and longer term absences.

Additionally Mersey Care NHS Foundation Trust has had a number of acquisitions for services over the last two years, where there had been inherent issues with those services - hence the need for support from us as a Specialist Mental Health Trust with good CQC rating.

Our internal performance data and our EAP service indicates that staff absent from work with stress that is primarily non- work related.  Our Trust works hard to ensure we support staff to prevent sickness absence via a wide range of initiatives and when staff are absent, we provide swift access and support for physical and mental health issues. Staff can access support 24/7 and we have a Trust wide programme of Health and Wellbeing designed to reduce sickness absence and presentism and improve our employee wellbeing.

Our sickness absence is being managed utilising an absence reduction plan which is based on the Department of Health’s 5 High Impact Changes and we are seeing a reduction in absence levels.

Due to the small amount of recorded allegations, individuals could be identified. The release of this information could cause distress to the individuals concerned. If individuals are identified it could also discourage staff or patients from reporting such allegations. It is therefore exempt under 40(2) of the Freedom of Information Act 2000.

Staff on patient sexual harassment

We are unable to provide a breakdown in financial years because to release this data could lead to the identification of the person(s) involved due to the low numbers, and would breach the Trust’s obligations under the Data Protection Act 1998.

There were a total of 12 complaints of alleged sexual harassment/abuse by another service user on a service user and by staff on a service user.

Alongside each of the categories listed in 2, please state the outcome of the complaint. For example unsubstantiated, written warning, dismissed, training requirement, police informed.

9 cases were unsubstantiated after an investigation

3 cases were withdrawn by the Service User

2 cases led to an employee being disciplined

The police were informed on 5 occasions. On 4 occasions these cases were not upheld.

The trust does not hold the information prior to 2011/12.

The majority of these payments were due to the running of a MARs scheme.

Given the need to support the flexibility to address periods of rapid change and service redesign, it can be agreed that a limited Mutually Agreed Resignation Scheme (MARS) can be introduced.  A MARS scheme is designed to create job vacancies in the Trust that can be filled by redeployment from other jobs or as a suitable alternative job for those at risk of redundancy.

MARS is a time-limited scheme under which an individual employee, in agreement with their employer, chooses to leave employment in return for a severance payment.  A MARS is not a redundancy or a voluntary redundancy
