Sexual Harassment

Further to your Freedom of Information request in respect of sexual harassment from 2014 to 2017, please find a response from the Trust below.

Due to the small amount of recorded incidents the trust cannot split the information into grades of staff or whether the incident was sexual harassment or assault.

How many staff have reported being sexually harassed/assaulted in the workplace by a colleague?

<5

Due to the small amount of recorded allegations, individuals could be identified. The release of this information could cause distress to the individuals concerned. If individuals are identified it could also discourage staff or patients from reporting such allegations. To provide a breakdown of years and staff grades is therefore exempt under 40(2) of the Freedom of Information Act 2000.

How many of these have resulted in an internal investigation or been referred to the police?

The service do an initial review to see if the case needs reporting to the police but also the views of the member of staff need to be taken into account as they may not want it to be reported.  But all incidents are investigated internally and disciplinary action taken depending on the outcome.  None of the case above were reported to the police.

How many staff have reported being sexually harassed/assaulted by a patient?

How many staff have been dismissed from their post as a result of a sexual assault or harassment report by a colleague?

1 member of staff was dismissed.

There were a total of 10 complaints of alleged sexual harassment/abuse by staff on a service user.

3 cases were withdrawn by the service user

How many staff have faced an investigation or been referred to the police as a result of a sexual assault or harassment report by a patient?

6 cases were unsubstantiated after an investigation

In one case the employee resigned before disciplinary procedures took place.  For further details a separate FoI request will need to be made to the Merseyside Police.
